MIX COSMETIQUES LLC, its affiliates, subsidiaries, or designees, provide their services to you subject to the following conditions. You may not modify or alter the material, nor may you copy or post the material on any network computer or broadcast the material in any media. Downloading the images of the products for sale on this site is strictly prohibited.

Tampering with the Site, misrepresenting the identity of a user, using buying agents, or conducting fraudulent activities on the Site is prohibited.

Neither MIX COSMETIQUES LLC nor its affiliates, subsidiaries, or designees, nor their respective officers, directors, employees, agents, third-party content providers, designers, contractors, distributors, merchants, sponsors, licensors, or the like (collectively, “associates”) warrant that use of the Site will be uninterrupted or error-free. Prices and availability are subject to change without notice. The MIX COSMETIQUES LLC logos and other trademarks on the site are the property of their respective owners and may not be reproduced, copied, or manipulated without the express, written approval of the trademark owner.

MIX COSMETIQUES LLC does not want to receive confidential, proprietary, or trade secret information through the Site (excluding information related to orders you submit). Any information, materials, suggestions, ideas, or comments sent to the Site will be deemed non-confidential, and by submitting such information, you grant MIX COSMETIQUES LLC an irrevocable and unrestricted license to use, modify, reproduce, display, and distribute such materials for any purpose. We will not use your name in connection with such materials unless required by law.

MIX COSMETIQUES LLC EVENT (WORKSHOP/CLASS/SERVICE) AND TICKET TERMS OF USE

Thank you for purchasing your Mix Cosmetiques ticket(s) (the “Ticket”)! These Terms of Use (the “Terms”) govern your use of the Mix Cosmetiques Service, as well as the use of the Ticket, including all features of Mix Cosmetiques’ website (the “Website”), user experience, and all content associated therewith (collectively, the “Mix Cosmetiques Service” or “Service”). By using, visiting, or browsing the Mix Cosmetiques Service, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Mix Cosmetiques Service, including the Website, and you should not purchase the Ticket.

These Terms also provide insight into how the Mix Cosmetiques Service works, the kinds of data collected, how bills are processed, and how Mix Cosmetiques interacts with you. Mix Cosmetiques hopes you enjoy your Mix Cosmetiques experience.

I. DEFINITIONS

• Event: The Event (otherwise referred to as workshop/class/event) you or the person for whom you purchased the Ticket attends.
• Payment Method: The method of payment for the Ticket you indicated during purchase.
• You/Your: Refers to the person who purchased the Ticket and includes any persons who eventually utilize the Ticket.
• Venue: The location where the Event takes place.
• Website: The website hosted by Mix Cosmetiques (www.mixcosmetiques.com).
• Ticket: A revocable license that you or a person for whom you purchased the Ticket may use to attend the Event.

II. HOW THE MIX COSMETIQUES SERVICE WORKS

Mix Cosmetiques provides cosmetics creation assistance and instruction at designated venues. Mix Cosmetiques reserves the right to make changes to the Service at its sole discretion and without notice.

• Availability: Events and specific artists/instructors at particular venues may change at Mix Cosmetiques’ discretion.
• Materials Provided: Mix Cosmetiques will supply all necessary materials for the Event. However, the quality of these materials may vary.
• End Result: No representations are made regarding the final product’s quality or color.
• Start Time: Instruction times are approximate, and the actual start and completion times may vary.
• Capacity Limitations: Attendance may be limited by venue capacity, and early arrival is recommended.

III. UNAUTHORIZED USE

Mix Cosmetiques products and creations are protected. Unauthorized copying, reproduction, sale, or distribution of Mix Cosmetiques products is strictly prohibited.

IV. PRIVACY POLICY AND COMMUNICATION

Your personal information is subject to Mix Cosmetiques’ Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to receiving communications from Mix Cosmetiques, including transactional emails and promotional announcements. To opt out of promotional emails, you may contact info@mixcosmetiques.com with the subject line “UNSUBSCRIBE,” or write to Mix Cosmetiques at 1215 N. 17th Ave, Superior, WI 54880, USA.

Mix Cosmetiques will not sell your email address to any third party.

V. GIFT TICKET CONDITIONS

Gift Tickets may only be used to attend the Event and cannot be exchanged for any other item. Each Gift Ticket has a maximum value of $10.

Gift Tickets are not refundable and have no cash value, but they can be transferred to another person.

By redeeming your Gift Ticket, you agree that Mix Cosmetiques has fulfilled all of its obligations regarding the redemption.

VI. BILLING

By purchasing a Ticket, you agree that Mix Cosmetiques is authorized to charge you the current fee for the Ticket, as well as any other charges you incur in connection with the Mix Cosmetiques Service, to the Payment Method you provided at purchase. Please note that prices and charges may change with notice.

“Billing” refers to a charge or debit against your Payment Method. The Ticket fee will be billed on the day of purchase, not on the day you attend the Event.

Ticket prices may vary due to promotional offers, and you authorize Mix Cosmetiques to charge your Payment Method for such varying amounts.

Ticket fees and charges are fully earned upon payment. Payments are non-refundable, and there are no refunds or credits for unused or partially used tickets. Your Ticket never expires. Mix Cosmetiques may provide refunds, discounts, or credits at its sole discretion, but this does not entitle you to future credits for similar situations.

Mix Cosmetiques will bill your Payment Method during Ticket purchase.

VII. RIGHT TO TERMINATE

Mix Cosmetiques reserves the right to terminate or restrict your use of the Service, without notice, for any or no reason.

Mix Cosmetiques does not warrant the quality or availability of any Event or materials used in connection with the Service.

VIII. SOCIAL MEDIA

You may connect your Mix Cosmetiques account to social media platforms like Facebook (“Social Media Accounts”). By connecting, you enable features designed to share information with others, such as showing your attendance at a Mix Cosmetiques event, the products you created, and who you attended with.

Mix Cosmetiques may enhance your experience based on your social media activity, including your Facebook “Likes” and profile information. Be mindful of your privacy settings on both Mix Cosmetiques and Facebook, which control what information is shared and with whom.

By connecting your Mix Cosmetiques account to a Social Media Account, you consent to the continuous release of information about you to others in line with your privacy settings. If you do not want information shared this way, contact info@mixcosmetiques.com to have it removed.

These features and the information shared may change without notice.

IX. CUSTOMER REVIEWS

Mix Cosmetiques encourages you to post reviews of events through the Service. Mix Cosmetiques reserves the right to promote, reject, remove, or edit any reviews at any time without notice.

Reviews should not contain offensive or inappropriate content, such as profane language, defamatory statements, or misleading information. Mix Cosmetiques may review and remove content at its discretion.

By submitting a review, you agree to the release of your review and rating to a public forum. If you do not want your review shared publicly, do not use the Review an Event feature.

The Review an Event feature may change without notice, as may the levels of information sharing.

X. AGE RESTRICTION

Mix Cosmetiques services are only for people over the age of 13 in non-drinking venues. If the event takes place at a venue that serves alcohol, attendees must be of legal drinking age. This information will be clearly stated on the event description page. Mix Cosmetiques is not responsible for underage attendees in such venues. If Mix Cosmetiques or its licensee finds out that an attendee is under the legal drinking age, they will not be allowed to participate, even if they have a ticket. You may be asked to present valid ID to confirm your age, and you agree to comply with this request.

XI. VENUE

At the event, you may encounter third-party services (TPS), such as food and beverage services provided by the venue. Mix Cosmetiques does not endorse or take responsibility for these services. You are responsible for any additional charges you incur, like food or drinks. TPS are offered solely for your convenience, and Mix Cosmetiques is not associated with these third parties, even if they use Mix Cosmetiques branding.

By using TPS, you acknowledge and agree that this may result in your personal information, such as a photo, being shared or publicly displayed. You also agree that using TPS is at your own risk, and Mix Cosmetiques is not liable for any issues that arise from their use. If you have concerns about TPS, you should contact the service provider directly.

XII. DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITY

The Mix Cosmetiques service, website, and all related content are provided “as is” and “as available,” without any warranties. Mix Cosmetiques does not guarantee uninterrupted service, error-free events, or that all features will be available at all times. We are not liable for any content errors, service interruptions, or issues with third-party services. This includes anything related to your event, the TPS, or any equipment used at your event.

In the event of any damages, Mix Cosmetiques’s total liability to you will not exceed the ticket price of the event.

XIII. INTELLECTUAL PROPERTY

Mix Cosmetiques is a registered trademark, and the website, including graphics, logos, and other elements, is protected by trademark and trade dress laws. You agree not to use or reproduce these materials without written permission from Mix Cosmetiques.

Any cosmetic recipes used during your event belong to Mix Cosmetiques, and you can only use them for the event itself. You agree not to copy or distribute the cosmetics you create at the event for profit. You do not retain any rights to the recipes once the event ends.

Photos taken at your event by Mix Cosmetiques, instructors, or staff become the property of Mix Cosmetiques. These photos can be used by Mix Cosmetiques at their discretion, including altering them for marketing purposes.

XIV. ENTERTAINMENT AND SERVICE CONTENT

Mix Cosmetiques provides entertainment and reserves the right to share and promote any filmed or photographed content from events through our services, including the website and social media platforms like Facebook. This may include photos and videos of you and other attendees. Any reviews, comments, or content posted by third parties on social media represent their opinions, not those of Mix Cosmetiques. Mix Cosmetiques is not liable for any loss or damage caused by your reliance on third-party content.

XV. USE OF INFORMATION SUBMITTED

When you send feedback, ideas, or suggestions to Mix Cosmetiques, either through the website, questionnaires, or other forms of communication, Mix Cosmetiques can use this information freely. This includes using it for developing, marketing, or improving products without any additional payment or acknowledgment to you. Mix Cosmetiques may also share your feedback with third parties for business purposes.

By submitting any ideas or feedback, you grant Mix Cosmetiques a worldwide, non-exclusive, royalty-free license to use, modify, or share it in any way, without further notice or approval from you.

XX. PROMOTIONS WITH TICKET CODES

Promotional codes can be used on the website but may only be redeemed once. They cannot be exchanged for cash, resold, or combined with other offers. A valid payment method will be required when redeeming a code, and it cannot be used with gift ticket purchases.

XXI. ARBITRATION AGREEMENT

You and Mix Cosmetiques agree to resolve any disputes through binding arbitration, rather than in court. This means there will be no trial by jury, and the decision will be made by a neutral arbitrator. This arbitration agreement also covers event attendees who use the tickets you purchase.

If you wish to seek arbitration, you must first send a written notice to Mix Cosmetiques, describing the claim and any relevant facts. Arbitration will take place in Wisconsin, unless otherwise agreed. You and Mix Cosmetiques waive the right to participate in any class-action lawsuit or collective legal proceeding.

XXII. GOVERNING LAW AND VENUE

These terms, and any disputes related to them, will be governed by the laws of Wisconsin, USA. Any legal disputes that are not subject to arbitration will be heard in Wisconsin.

XXIII. WAIVER OF RIGHTS

Failure to enforce any of the terms at any given time does not mean Mix Cosmetiques waives its rights to do so later.

XXIV. SIGNIFICANCE OF HEADINGS

The section headings in these Terms are meant to make them easier to read but should not affect how they are interpreted.

XXV. SEVERABILITY

If any part of these Terms is found to be unenforceable, the rest of the Terms will still apply.

XXVI. NO ADVERSE CONSTRUCTION

If there is any ambiguity in these Terms, neither you nor Mix Cosmetiques will be favored just because one of you drafted the terms.

XXVII. SURVIVAL

Certain sections of these Terms, such as arbitration and indemnity, will continue to apply even after your event has ended.

XXVIII. AUTHORITY

You confirm that you have the right and authority to agree to these Terms on behalf of yourself and any event attendees.

XXIX. FURTHER ASSURANCES

You agree to cooperate with Mix Cosmetiques by providing any additional information or taking necessary actions to fulfill these Terms.

XXX. FORCE MAJEURE

Neither you nor Mix Cosmetiques will be responsible for failure to perform obligations due to circumstances beyond control, such as natural disasters, wars, or government interventions.

XXXI. ELECTRONIC TRANSACTIONS

You agree to conduct transactions electronically, including purchasing tickets and accepting these Terms.

XXXII. DEFENSE AND INDEMNITY

You agree to defend, indemnify, and hold Mix Cosmetiques harmless from any claims, disputes, or legal actions arising from your ticket purchase or event attendance. This includes covering any related expenses or legal fees.
